Which Traffic Violations Qualify for Expungements in Illinois?
In general, most moving violations, such as speeding, reckless driving, and driving while under the influence (DUI) are not eligible for expungement or sealing. There are some exceptions, however. If you fit into one of the following circumstances, you may be able to have your record expunged or sealed:
- Reckless driving if you: (1) received court supervision, (2) were under 25 at the time of the offense, (3) are currently 25 or older now, and (4) have no other convictions on your record for DUI or reckless driving;
- Driving an insured motor vehicle, registration suspended for no insurance, and having a false insurance card are eligible 5 years past the successful completion of court supervision.
- Driving while your driver's license is suspended or revoked.
